Terms and Conditions
The following terms and conditions apply for any purchase made in our showrooms or website. If you place an order in our showrooms or website you indicate that you are in agreement with these terms and conditions. Please read them carefully and contact us at [email protected] should you have any question.
All FLOOR SAMPLE sales are final. NO cancellations, NO returns, NO refunds and NO exchanges are allowed. Modo Furniture does not grant any warranty on FLOOR SAMPLE items and Customer agrees to accept the product in an “AS IS” condition.
Any item that is NOT a FLOOR SAMPLE SALE is considered a SPECIAL ORDER. NO cancellations are allowed on SPECIAL ORDERS since Modo Furniture places the order for the item at the moment of purchase. Customer assumes full responsibility for ensuring that furniture will fit the space, purpose and intended use. Seller shall not be responsible in any way for any consequential damages incurred by Customer regardless of the cause, whether a delay or mistake in delivery or the furniture itself, its quality, function or use without limitation.
All CUSTOM-MADE ORDERS require a 50% deposit which is NOT REFUNDABLE. If a Customer refuses to purchase a CUSTOM-MADE ORDER, seller shall keep the deposit as liquidated damages. It is the Customer’s responsibility to provide the exact information such as dimensions, colors and materials needed for a CUSTOM-MADE ORDER. Modo Furniture will not be held responsible for any mistakes on the information provided by the Customer. All CUSTOM-MADE ORDERS have an estimated delivery date given in good faith, Modo Furniture will not be liable for any loss, damage, cost or expense related to delays incurred in any CUSTOM-MADE ORDER.
All products are subject to availability and may be withdrawn at any time.
For all In-store Orders, Customer will be informed of the Estimated Availability Date for all products prior to creating an Invoice, if Customer agrees to the Estimated Availability Date, Modo Furniture will not be responsible for delays in stock replenishment and no order may be cancelled or be eligible for a refund based on late merchandise arrival.
For all Online Orders, Customer will receive a notification of the order and Modo Furniture will contact the Customer to inform the Estimated Availability Date of the purchased items, if Customer agrees to the Estimated Availability Date, Modo Furniture will not be responsible for delays in stock replenishment and no order may be cancelled or be eligible for a refund based on late merchandise arrival. If Modo Furniture does not supply the goods for any reason, we will not charge you for these and we will refund any money already paid for them. However, Modo Furniture will not be responsible for compensating the Customer for any other losses that may arise if the goods are not supplied.
Our delivery and assembly service is available Monday through Saturday from 10:00 am to 6:00 pm. We provide this service for Miami-Dade and Broward counties. Customer must inform Modo Furniture if delivery is required outside these counties in order to get an accurate delivery fee estimate.
Modo Furniture will provide the customer with a 2-hour window in which the delivery staff should arrive to the premises. Customer must inform Modo Furniture at least 3 days prior to delivery if we need to provide a Certificate of Insurance to the Condominium’s Management Office, failure to do so will require to schedule a new delivery date and Customer must assume all transportation charges. Our delivery staff does not hang mirrors, pictures or any other kind of furniture that requires wall installation.
For all online orders, Modo Furniture will contact the customer and set up the delivery date subject to item availability.
It is the Customer’s responsibility to check and inspect all items received at the moment of delivery, in case of a defective item the Customer should contact the store immediately in order to process the exchange accordingly. Our delivery staff will provide a Delivery Form which is for the Customer to sign if all items have been received in good condition, once our staff leaves the premises and the Delivery Form is signed, the Customer assumes full responsibility for all delivered items. Modo Furniture will not accept claims of any type on any item delivered if the Customer did not contact the store to report a defective item at the moment of delivery.
Modo Furniture will not be liable for any loss, damage, cost or expense related to any delay in shipment or delivery.
IN-STORE PICK UP
Customers may pick up the item(s) purchased online or at any of our showrooms. All pick ups must be scheduled at least 2 days before with the store location where the Customer plans to pick up the items. It is the Customer’s responsibility to check and inspect all items for pick up before they leave the store. In case of a defective item, Customer must inform immediately to the store representative in order to process the exchange accordingly. Modo Furniture will not accept claims of any type on any item picked up at any of our showrooms if the Customer did not report any damages or defects before leaving the store. Customer is responsible for providing a safe, spacious vehicle for transportation of all items. Modo Furniture assumes no responsibility for items that are damaged during transportation in a Customer’s vehicle.
All exchanges and returns are subject to seller approval. All shipping and delivery charges as well as a 35% restocking fee based on the purchase price will be assessed on seller approved returns or exchanges. All approved returns or exchanges must be submitted with the original Invoice and the item(s) in the original packaging and condition, all transportation charges are assumed by the Customer. Merchandise purchased from Modo Furniture may only be returned for store credit or exchange upon meeting certain criteria.
Actual cost of shipping replacement item to you will not be credited or refunded and is subject to additional charge. Store credit is valid for one year from date of issue. Thereafter, unused credit is forfeited after one year.
Modo Furniture neither grants nor implies any warranties on any products. All warranties provided, if any, are Manufacturer’s Warranties. If you need warranty service, we will assist you in contacting the manufacturer. In select cases, Modo Furniture may assist in providing warranty service. In those cases, Modo Furniture will charge a fee for warranty administration, as well as freight charges, pick-up fees, and delivery fees, if incurred. Warranty claims will not be accepted based on the following :
- Accidental stains caused by any food or beverage, human or pet bodily fluids, grass, grease, ballpoint pen ink, marker, nail polish, nail polish remover, gum, cosmetics, lipstick, and crayon.
- Accidental damage from rips, tears, cuts, burns, and punctures
- Claims made outside the manufacturer’s warranty coverage period
In the event a product is listed at an incorrect price due to typographical error or error in pricing information from our suppliers, taxes or duty changes, we shall have the right to refuse or cancel any orders listed at the incorrect price whether or not the order has been confirmed. If your credit card has already been charged and we subsequently cancel your order, we will immediately issue a credit to your credit card account in the value of the incorrect price including delivery charges.
YOUR ONLINE ACCOUNT
You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. If you are under 18, you may use our website only with involvement of a parent or guardian. Modo Furniture reserves the right to refuse service, terminate accounts, remove or edit content, or cancel orders at their sole discretion.
All sales are tax-free if delivered outside of the State of Florida.
